DC-10 Drops Flame Retardant Near Moorpark

It truly is a remarkable sight to see this massive plane dump a 2-mile-long line of flame retardant.   The DC-10 arrived here this morning at around 9:15 and made its drop near Moorpark College.

Dear Chairman Dodd and members of the Banking Committee,

We are writing to ask you to postpone the confirmation of Ben Bernanke until the Federal Reserve releases documentation that will allow the public and the Senate to have a full understanding of the commitments that the Federal Reserve has made on our behalf. Without such an understanding, it is impossible to know whether Chairman Bernanke is fit to serve another term and fulfill the Federal Reserve’s dual mandate to ensure price stability and full employment. A list of said documentation is enumerated below.

Since 2007, the Federal Reserve has expanded its balance sheet by $1.2 trillion and taken on substantial credit, interest-rate and foreign exchange risk. It has lent immense sums to some financial institutions against overvalued collateral, while refusing to lend to others with no clear standards as to who was rescued and who was not. It has set up holding companies using no-bid contracts, and guaranteed substantial liabilities of Citigroup, all the while keeping information about its actions secret from the public and Congress. This is in stark contrast to the analogous period in the 1930’s, when the Reconstruction Finance Corporation fully disclosed loans and collateral to Congress.

Today, big banks are being bailed out and have a substantially lower cost of capital through an implicit government backstop even as Americans themselves are seeing their pay cut. This lower cost of capital – at government expense – coupled with increased scarcity of credit is resulting in the banks recapitalizing by charging American consumers higher credit costs, including record overdraft fees and much higher credit card rates.

As you know, the Federal Reserve has a chartered mandate of both price stability and "full" employment. Since 2002, the Bernanke joined the Federal Reserve board has aligned himself with Alan Greenspan’s activities, the incomes of Americans have actually declined in absolute terms, with incomes projected to decline a further 5% in 2009. One quarter of all mortgage holders owe more than they own, with that number projected to rise to nearly 50% by 2010. Consumer asset prices, most importantly housing, continue to fall, and unemployment continues to rise. This raises real questions about Bernanke’s tenure as Federal Reserve chairman, and about where trillions of dollars have gone.

Federal Reserve secrecy must be understood in the context of an intellectual dogma which Alan Greenspan inculcated into the fabric of the Federal Reserve and the economic profession, and which has severely harmed ordinary Americans. Bernanke’s "Great Moderation" speech in 2004 didn’t even consider the idea that the economy was becoming more unstable, even as risks were being built into the system by the politics he encouraged. He ignored evidence of a crisis, saying in 2007 that the turmoil was contained to subprime mortgages, ignoring the bankruptcy of over 100 mortgage originators, and the clear evidence the crisis would spread. Now, even as the crisis is said to be subsiding, we still do not have credit markets that are able to function without substantial government support, we have not addressed institutions that are "too big to fail" which the Fed oversees, bank credit availability is again shrinking (posing risk of further increasing already high unemployment), and toxic assets in the system on the books of both private banks and the Federal Reserve have still not seen price discovery.

Chairman Bernanke’s policy-making errors might be chalked up to errors of judgment, and it’s possible to argue that he has been chastened by the last few years of turmoil. What is more disturbing is how the Federal Reserve has refused to disclose the details of its commitments to the bankers who came close to destroying the economy. The Bernanke Fed’s execution of its dual mandate cannot be judged without consideration of those commitments, which would require the Fed to disclose documents which it still contends the public has no right to see. Specifically, we ask that you postpone the confirmation of the Chairman until after the Federal Reserve discloses:

(1) Information that Bloomberg reporter Mark Pittman has requested via a Freedom of Information Act Request on the Bear Stearns rescue and that the Federal Reserve is contesting in the courts,* and which Manhattan Chief US District Judge Loretta Preska has ordered be turned over by the Federal Reserve.

(2) Information that Rep. Grayson requested in February at a hearing and the follow-up letter on which institutions received the $1.2 trillion added to the Federal Reserve’s balance sheet, how much each institution received, and what was promised in return.

(3) All Federal Reserve documents that went to Attorney General Andrew Cuomo’s office relating to the Bank of America/Merrill Lynch merger in which potentially illegal and coercive activity might have occurred, as well as all Federal Reserve documents relating to the lawsuit pursued by the Merrill Lynch shareholders in the US District court for the Southern District of New York.

(4) Transcripts of all Open Market Meeting Minutes up to and including that of June 2009, transcripts of which are normally withheld from the public for five years.

(5) Full disclosure of all terms and conditions of all off-balance sheet Fed Transactions in the past three years.

The Federal Reserve must become transparent and open with Congress and the public about its behavior during the financial crisis. Thank you for your consideration of this matter.

The falling US dollar is giving ammunition to the critics of the Obama administration and fuelling broader concerns about the potential erosion of America’s reserve currency status.

The depreciation of the US dollar is sparking growing jitters among critics of the Obama administration over the potential loss of America’s reserve currency status. Economists point out that a declining dollar could prove a boon to the US economy in the absence of credible anxiety over inflation.

Republican politicians have highlighted the dollar’s slide as evidence of waning US power.

Sarah Palin, the former vice-presidential Republican candidate, on Wednesday sought to link the dollar decline to rising US indebtedness and dependence on foreign oil. “We can see the effect of this in the price of gold, which hit a record high today in response to fears about the weakened dollar,” she wrote on her Facebook site.

With other nations also expressing concern about dollar weakness, the administration is at pains to emphasise that it understands the responsibilities that come with issuing the world’s reserve currency and will live up to them.

“It is very important to the United States that we continue to have a strong dollar,” Tim Geithner, Treasury secretary, said at the weekend. “We recognise that the dollar’s important role in the system conveys special burdens and responsibilities on us and we are going to do everything necessary to make sure we sustain confidence.”

Angst about the dollar – which has fallen 11.5 per cent on a trade-weighted basis over the past six months – extends beyond ideological conservative political circles.

Last week, Robert Zoellick, president of the World Bank, warned that “the United States would be mistaken to take for granted the dollar’s place as the world’s predominant reserve currency.”

Much of today’s debate echoes the traditional political response in the US whenever the currency depreciates. But it is now accompanied by warnings from America’s creditors, many of which are widely rumoured to be eyeing large purchases of US real assets such as property and companies.

“The dollar has always been a testosterone issue among America’s political classes,” said Norm Ornstein, a veteran analyst at the conservative American Enterprise Institute.

“This time there may be a legitimate debate to be had over the dollar’s reserve status, but Sarah Palin is not qualified to participate in it.”

While the latest swoon in the dollar is attracting attention, analysts say that it needs to be put in context. In trade-weighted terms, the dollar is essentially back to where it was at the start of the financial crisis on August 9, 2007, according to Federal Reserve data.

While the price of gold has gone up, financial market measures of inflation expectations have not. The yield on the 10-year note was trading at 3.18 per cent on Wednesday. Indeed, analysts say that the dollar’s slide stems more from investors’ growing appetite for risk and the prospects of interest rate rises elsewhere.

“The first order reason for the decline in the dollar has been the normalisation of markets,” said Ken Rogoff, a Harvard professor and former IMF chief economist. “The financial crisis probably has brought forward the day when the dollar is no longer dominant – but maybe from 75 years to 40 years.”

Obama White House Can’t Find – or Won’t Release – Millions of Bush e-mails

President Barack Obama has a problem.

In February, the Obama administration, siding with former President George W. Bush, tried to kill a lawsuit that sought to recover what could be millions of missing White House e-mails in a stunning reversal of Obama’s rhetoric about Bush secrecy on the campaign trail.

Two advocacy groups had sued the Executive Office of the President, including one of the groups that helped derail former House Speaker Tom DeLay. They said that large amounts of White House e-mail documenting Bush’s eight years in office were missing, and that the government needed to undertake an extensive recovery effort. The emails were seen as crucial as the “deleted” days include ones in the run up to the Iraq war and the outing of covert CIA officer Valerie Plame Wilson.

In March, the groups suspended their lawsuit, noting that the Obama team was willing to negotiate a settlement. Since then, little progress has been made.

“It’s very frustrating,” says Anne Weismann, Citizens for Ethics and Responsibility in Washington chief counsel, told Mother Jones for an article Wednesday. “Here we are, nine-plus months after [Obama's inauguration], and we’re really not any closer to feeling the missing emails have been restored. It’s kind of nutty to me that it’s taken them so many months.”

“Among the plaintiffs’ biggest gripes,” writes Mother Jones’ Nick Baumann, “is that the Obama team is using the Bush administration’s strategy—a flawed one, the groups say—to resurrect the missing emails. The White House has hired private contractors to conduct a statistical analysis of its archived email to determine on which days messages are unaccounted for. But that’s not standard private-sector practice in these sorts of cases, says Weismann. It’s far more common for businesses that have lost emails to restore their backup tapes and compare those results with their archives, she says.

The two administrations have spent at least $9.4 million on their effort to recover the emails, more than double that which was originally appropriated for the task. Citizens for Ethics says they really don’t know where the money’s gone. The Bush administration had told CREW they’d located 38 boxes of documents that might be relevant to their Freedom of Information Act request, but the Obama administration has released very few pages.

During its first term, the Bush White House failed to install electronic record-keeping for e-mail when it switched to a new system, allegedly resulting in millions of messages that could not be found.

The Bush White House “discovered the problem” in 2005 and rejected a proposed solution.

The exact number of missing e-mails is unknown, but several days on which e-mails were not archived covered key dates in a Justice Department inquiry into the roles of Vice President Dick Cheney and his aides in leaking the identity of covert CIA agent Valerie Plame Wilson.

Ironically, Cheney’s office is missing emails from the very day President Bush told reporters he’d “take care of” whatever staff member had actually leaked the CIA agent’s name.

“If there is a leak out of my administration, I want to know who it is,” Bush said Sept. 30, 2003. “And if the person has violated the law, the person will be taken care of.”

No e-mails were archived on the very day the probe was announced and White House officials were ordered to maintain anything that could become evidence in the investigation that ended the conviction of I. Lewis “Scooter” Libby, Cheney’s former chief of staff, on perjury and obstruction of justice charges.

Emails are missing from at least some of 473 days of Bush’s presidency.

The White House did not respond to Baumann’s request for comment.

Journalists target Obama over 'shield law'

WASHINGTON (CNN)– Journalists are blasting President Obama over his stance on proposed legislation that would protect journalists from having to reveal the identity of their sources.

In an email sent out late Friday, the Society of Professional Journalists expressed 'outrage' over President Obama's proposed changes to the shield bill that would protect reporters from having to divulge confidential sources in court.

"Not long ago, President Obama was a key supporter of this bill, but after one meeting with his national security team he appears to have been scared into making this poor decision," SPJ President Kevin Smith said in a statement. SPJ cited an event in April 2008, where candidate Obama threw his support behind the proposed legislation, the Free Flow of Information Act.

"President Obama was elected by the people, for the people. It's time for him to stand up and support legislation that gives those people the power to have better oversight of their government," Smith said.

The Society of Professional Journalists, which was founded in 1909, has boast over 10,000 members nationwide. Its Their mission to promote "the free flow of information vital to a well-informed citizenry; works to inspire and educate the next generation of journalists; and protects First Amendment guarantees of freedom of speech and press."

Lawyers for journalists have often cited a 1972 Supreme Court ruling to say they were protected by the First Amendment from having to testify about confidential sources. But in 2003, a federal appeals court judge said that ruling does not protect journalists.

Thirty-six states (including Washington, D.C.) have enacted some form of shield law, but there is no Federal law protecting a reporter's privilege, which the sponsors of the Free Flow of Information hope to correct.

Including Congressman Ron Paul, the bill's author, 300 members of the House of Representatives now support an audit of the Federal Reserve. S 604, the Senate companion bill, currently has 30 cosponsors.

HR 1207 would open up the Fed's funding facilities, such as the Primary Dealer Credit Facility, Term Securities Lending Facility, and Term Asset-Backed Securities Lending Facility to Congressional oversight and an audit by the non-partisan Government Accountability Office. Additionally, audits would include discount window operations, open market operations, and agreements with foreign central banks, such as ongoing dollar swap operations with European central banks.

"Less than a year ago, an audit of the Federal Reserve wasn't on anyone's radar. Now the idea has the support of seventy five percent of the American people and a majority of Congress," said Jesse Benton, Senior Vice President at the Campaign For Liberty, which has been leading the grassroots effort in support of the bill since its introduction. "The policies put forth by the Fed have played a major role in the economic trouble our nation faces, so an audit of its operations is the common sense thing to do."

"When 300 members of the House support a bill, that indicates overwhelming support by the American People. HR 1207 should be brought to the House Floor for a prompt vote," continued Benton.

Support for the bill, which has been gathering steadily since being introduced earlier this year by Congressman Ron Paul, has reached a fever pitch in recent weeks with widespread media coverage on the release of Paul's highly anticipated book, End The Fed, and hearings on Fed transparency in the House Financial Services Committee held late last week.




Comments from the Ron Paul Newsletter. It's not known who the author of the comments are, if it was indeed Ron Paul himself, but it was published by Ron Paul. So somewhere down the line he must have approved it. Or does he just put his name and sign off on anything that is put in front of him? Would someone who says he's not a racist put out a newsletter with this kind of comments?


"The controversial newsletters include rants against the Israeli lobby, gays, AIDS victims and Martin Luther King Jr. -- described as a "pro-Communist philanderer." One newsletter, from June 1992, right after the LA riots, says "order was only restored in L.A. when it came time for the blacks to pick up their welfare checks."


"Another says, "The criminals who terrorize our cities -- in riots and on every non-riot day -- are not exclusively young black males, but they largely are. As children, they are trained to hate whites, to believe that white oppression is responsible for all black ills, to 'fight the power,' to steal and loot as much money from the white enemy as possible."

Is Ron Paul someone we want in Washington who would support racist and hateful remarks like this in his own newsletter? Is this why he is the darling of the extremist supporters? Protect your rights and your freedoms, do not support Ron Paul. Ron Paul is undermining this country with the help of his extremists supporters.

Warren Buffett balked at conflict of interest

BREAKING 10:08 AM ET:Vanity Fair will report in the next issue of the magazine that US Treasury Secretary Henry Paulson — a former head of the investment bank Goldman Sachs — tried to orchestrate secretive deals in the midst of the financial crisis but got blowback from prominent investor Warren Buffett. The following press release was obtained by Raw Story; the magazine appears today on newsstands in New York and Los Angeles.

NEW YORK, N.Y.—The government secretly tried to orchestrate a deal involving Goldman Sachs in the week following Lehman Brothers’ collapse and considered using the Federal Reserve to help support such a transaction, Andrew Ross Sorkin reports in the new issue of Vanity Fair.

In an excerpt from his forthcoming book, Too Big To Fail: The Inside Story of How Wall Street and Washington Fought to Save the Financial System—and Themselves, Sorkin reports that the deal, which was nearly consummated, would have merged Goldman Sachs and Wachovia. Henry M. Paulson, the Treasury secretary and former C.E.O. of Goldman, was deeply involved in the process, contacting both Lloyd Blankfein, Goldman’s current C.E.O., and a Wachovia board member, and strongly urged both to consider it. Wachovia’s C.E.O., Robert Steel, was a former vice-chairman at Goldman Sachs and Paulson’s former number two at the Treasury Department.

Sorkin reports that Warren Buffett was also contacted about investing in the merged company, but told a banker at Goldman that it would never happen. “By tonight the government will realize they can’t provide capital to a deal that’s being done by the former firm of the Treasury secretary with the company of a former vice-chairman of Goldman Sachs and former deputy Treasury secretary,” Buffett said. “There is no way. They’ll all wake up and realize, even if it was the best deal in the world, they can’t do it.”

Jim Wilkinson, Paulson’s chief of staff, realized that such a deal would be a public-relations nightmare at the worst possible time—just as they were trying to pass TARP. “Hank, if you do this, you’ll get killed,” Wilkinson frantically told his boss. “It would be fucking crazy.” Paulson, he said, would lose credibility; he would be accused of lining the pockets of his friends at Goldman; the “Government Sachs” conspiracy theories would flourish.

Rodgin Cohen, a Sullivan & Cromwell lawyer who was advising both Wachovia, on parallel talks with Morgan Stanley, and Goldman Sachs, on its bank-holding-company application, was the first to suggest that the government attempt a shotgun wedding between Goldman and Wachovia, Sorkin reports. He offered up the idea in a phone call to Kevin Warsh, a governor at the Fed, saying that it wasn’t an officially sanctioned plan by his clients, just a friendly suggestion from an old-timer in the business. He said he knew it was a long shot—the “optics,” he acknowledged, would be problematic, given that Paulson and Wachovia C.E.O. Robert Steel were both former Goldman men—but it would solve everyone’s problems: Goldman would get the deposit base it needed, and Wachovia would have its death sentence stayed.

According to Sorkin, Goldman co-president Gary Cohn had agreed to engage in talks with Wachovia only on the presumption that the Fed would help Goldman guarantee some of Wachovia’s most toxic assets. And Warsh, in a bold gesture, made a commitment that the Fed would strongly consider it. Paulson spoke with Blankfein and told him to take the talks seriously. “If you go into this looking for all the problems and how much help you’re going to get, it’s never going to happen,” he said, adding, “You’re in trouble, and I can’t help you.”

Much to their dismay, Cohn and Steel spent 24 hours working on a deal that they thought was near closure—and had the support of the Fed—but which ultimately died after Paulson, Bernanke and Geithner decided against pursuing it, in part, because of the “optics” of Goldman’s ties to the government. “I’m sorry. I understand—I’m just as frustrated as you are. We just don’t have the money; we don’t have the authorization,” Warsh explained.

At the same time, Sorkin reports, the Federal Reserve also tried to push Goldman Sachs and Citigroup together, but Vikram Pandit, Citi’s C.E.O., rejected the idea. “Well, that was embarrassing,” Blankfein exclaimed after he got off of one phone call with Pandit.

Meanwhile, the government demanded Morgan Stanley merge with J. P. Morgan, an idea that both John Mack, Morgan Stanley’s C.E.O., and Jamie Dimon, J. P. Morgan’s C.E.O., did not want to pursue, but both held brief talks at the government’s urging.

Paulson, Bernanke, and Geithner told Mack that he should be willing to sell his firm to J. P. Morgan for $1 a share. Mack, in an impassioned phone call with the three government leaders, rejected their demand: “There are 35,000 jobs that have been lost in this city between A.I.G., Lehman, Bear Stearns, and just layoffs. And you’re telling me that the right thing to do is to take 45,000 to 50,000 people, and put them in play, and have 20,000 jobs disappear? I don’t see how that’s good public policy.”

The November issue of Vanity Fair hits newsstands in New York and Los Angeles on September 30 and nationally on October 6.

I come from Welsh stock, we are people of our word. If he was elected by the majority of the people I would have to support him as president as I said I would. Would I be happy, about as happy as you are with Obama.
